SYS Ultimate Event Ltd - Booking Terms and Conditions
The following information includes important contractual terms and conditions, which apply to bookings you make with SYS Ultimate Events Ltd. These conditions include some exclusions and limitations of liability. You should therefore read them carefully. We reserve the right before a booking is accepted, to withdraw or alter these conditions.
All bookings are subject to SYS Ultimate Events Ltd Terms and Conditions.
I understand that even under the safest conditions bobsleigh / bob
skeleton activities involve a number of inherent risks that are beyond
the control of ‘SYS’ The Ultimate Event Company Limited / The Ultimate
Travel Company Limited and Host Track Management. Save to the extent
otherwise required by law, I waive any and all rights/claims I may now
or at any time in the future have against, and release from all
liability and agree not to sue and agree to indemnify and hold harmless
‘SYS’ The Ultimate Event Company Limited / the Ultimate Travel Company
Limited and Host Track Management together with their principles,
directors, officers, employees, and representatives for any liability
regarding personal injury –mental or physical, death, damage or loss of
any kind suffered or sustained by me arising out of my participation on
the ‘start track’ at the University of Bath, and or a host bobsleigh
track unless it results from the negligence as recognised by English
law of ‘SYS’ The Ultimate Event Company Limited and Host Track
Management as the case may be.
I am mentally and physically fit. In the unlikely event of an accident
occurring I agree to being given first aid by a suitably qualified
member of ‘SYS’ The Ultimate Event Company Limited and Host Track
Management or Staff. I am a volunteer and participating of my free
will. I will comply with the safety regulations set by ‘SYS’ The
Ultimate Event Company Limited and Host Track Management I confirm and
understand the terms of this consent and acceptance of risk certificate
and will comply with its terms
Booking Conditions
Please note SYS The Ultimate Event Company is the trading name of SYS
The Ultimate Event Company Limited who are operationally responsible
for the events. The Ultimate Travel Company Limited manage bookings and
travel support services on behalf of SYS The Ultimate Event Company
Limited.
Making Your Booking
Please complete the booking form and forward it toThe Ultimate Travel
Company Ltd We will then send you a comprehensive booking form
including the rates for for events and additional activities. About 8
weeks before departure we shall send you further information relevant
to the tour you have booked, together with a final invoice, which will
also show any surcharges due. You must pay the invoice within 10 days
of the invoice date, otherwise we may treat the booking as cancelled
and apply our cancellation charges. Your travel documents are
dispatched about 10 days before the tour departs. If you would prefer

Airlines & Other Suppliers
The Ultimate Travel Company Ltd acts only as agents for the owners of
accommodation, services and activities provided, for all carriers by
air or otherwise and for road transport proprietors, and all bookings
must be accepted subject to the ticket or transport conditions and
regulations of the carriers or transport proprietors, and also subject
to the laws of the country in which such carriage or other
facility/event is required.
Passport, Visas & Health
All clients are personally responsible for ensuring that they have a
valid passport, relevant visa/s and conform to the health regulations
required by the country/s that will be visited during the tour.
Surcharges
Our prices are based on tariffs, other costs, and exchange rates taken
from the Financial Times as at the date of publication shown on the
relevant itinerary. The price of your holiday is subject to surcharges
on the following items: Government action, currency, fuel for road
vehicles and increases in scheduled airfares. Even in these cases we
will absorb an amount equivalent to 2% of the holiday price, excluding
insurance premiums and any amendment charges. Only amounts in excess of
this 2% will be surcharged. If this means paying more than 10% on the
holiday price, you will be entitled to cancel your tour within 14 days
of the invoice issue date, with a full refund with the exception of any
insurance premium paid and your deposit.
Cancellation
You or any member of your party may cancel your tour at any time
providing that the cancellation is made by the person who signed the
booking form and is communicated in writing. As this incurs
administration costs we will retain the deposit and in addition will
apply cancellation charges as shown below:

If you are obliged to cancel you may with reasonable notice transfer your booking to a third party who satisfies required participating in that event, but we will retain your deposit to cover the administration and transfer costs
Alterations by us
We will do our utmost to provide the event arrangements that have been
confirmed, but we must retain the right to modify or cancel any event,
tour, flight schedule, accommodation or arrangement, if unforeseen
circumstances amounting to a force majeure arise. In such
circumstances, we will inform you as soon as possible and, should the
change be such, that it alters the nature of the tour, we shall give
you the choice of an alternative tour or a full refund of all money
paid. In recognition we will absorb all financial loss consequent upon
cancellation due to force majeure. We shall not cancel any tour for
reason of political tension or natural disaster unless specifically
recommended to do so by the Foreign Office.
Alterations by you
We will do our best to make any alterations you may require after
confirmation has been issued, subject to availability and to the
payment of any increased costs relevant to the change. Any requests for
alteration to an itinerary should be made in writing and signed by the
signatory of the original Booking Form. If alterations are made less
than 8 weeks prior to departure, an additional £30 per booking charge
will be levied together with any communications costs incurred.
Event Cancellation
Events are costed on a minimum number of passengers travelling
together. If this minimum number is not reached we will either cancel
the Event and offer a refund in full or, subject to the client’s
agreement, we will operate the Event at the necessary supplement.
Our Liabilities
We do not exclude or limit any liability to our clients which may arise
from proven negligence by any person employed directly by us or by our
suppliers and subcontractors, servants or agents of the same whilst
acting in the course or their employment (other than air and sea
carriers performing any domestic, internal or international carriage of
whatsoever kind) in respect of death, bodily injury or illness. Such
liabilities shall be subject to English law and all proceedings shall
be within the exclusive domain of the English courts. We shall
endeavour to afford general assistance to our clients in the event of
illness, injury or death during the period of the tour. We accept
responsibility for ensuring that all parts of the tour are supplied as
described and that all services shall reach a reasonable standard.
These obligations and responsibilities shall be limited to where
international conventions in respect of air or sea carriers apply.
Naturally we cannot assume responsibility for loss or expense due to
war, riots, strikes, terrorist activities or natural disaster.
Complaints
We will always endeavour to resolve any complaints on the spot, however
if the matter cannot be resolved you must write to Tony Wallington,
Managing Director (SYS The Ultimate Event Company) within 14 days of
the end of the Event. We will endeavour to resolve the problem as
promptly as possible. In the unlikely event that the problem is not
amicably resolved the case will be referred to arbitration with the
Arbitration Act 1950 or any statutory re-enactment.
Credit Card Payment
We do have the facility to accept payment by most credit card companies
(excluding American Express) and Eurocheque, however a service charge
of 2.75% of the value of the relevant payment will be levied to cover
costs incurred. This does not apply to Switch of Delta
Baggage and Personal Effects
These remain your responsibility and risk at all times.
Event Leaders
The Event Leader, in communication with the appropriate medical advice
if applicable, has the right to disqualify any client at any time
during the course of the Event, if considered necessary for the safety
or well being of the individual or in the Event Leaders opinion the
client’s actions materially are affecting the enjoyment of the Event
for the remainder of the group. Any decision with regard to any
reimbursement for any part of the Event not completed will be decided
between the Managing Director of SYS The Ultimate Event Company and the
Event Leader.
Personal Event Insurance
We require that you take the Activity Travel Insurance which covers
your travel needs in addition to participating in the event. The cost
of insurance is included in the price of the package and runs for 5
days. Cover can be extended by paying an additional premium at the time
of booking,
Travel Insurance
The SYS The Ultimate Event Company Ltd has arranged, through Fairmont
Insurance Services Group Ltd, a travel insurance service for its
clients which includes medical and accident cover. (Please note that
this insurance is only available to residents of the United Kingdom).
Benefits under this insurance policy are underwritten by a consortium
of leading insurers by Travel and Personal Underwriters Limited.
Below is a summary of the cover and benefits available under the travel and event insurance scheme. A more detailed summary will be sent to you with your confirmation of booking. In any event you may ask for a specimen copy of the full policy wording should you wish to examine this in advance.

* Premiums are inclusive of Insurance Premium Tax (17.50%) Strict Medical Health Requirements - Pre-existing Medical Conditions.
You will not be covered:
1. For any trip where at the time of taking out this insurance, the person whose condition gives rise to a claim is;
a) is receiving, or is on a waiting list for in-patient treatment in a hospital or nursing home; or
b) has received a terminal prognosis; or
c) is travelling against medical advice or for the purpose of obtaining treatment; or
d) is expected to give birth before or within fourteen weeks of the date of arrival home;
e) is suffering or has suffered, from any diagnosed psychiatric disorder, anxiety or depression.
Note: The above exclusion applies not only to you, but also to close relatives or other persons on whom the trip depends.
2. For trips outside of the United Kingdom where at the time of taking out this insurance you answer "yes" to any of the following 'Medical Screening Questions" and fail to contact the Medical Screening Line.
a) within the last year, have you been treated as a hospital in-patient or been under the care of a specialist consultant (including being referred)?
b) have you ever been treated for a breathing or heart related condition (including angina) and are still taking medication, or receiving follow up consultation?
c) have you ever been diagnosed with cancer?
If you have answered 'yes' to any of the above questions, telephone the
Medical Screening Line on 0800 281488 between the hours of 9am and 5pm
Monday to Saturday, to confirm acceptability of cover.
Medical Screening
If you need to telephone the Medical Screening Line, you will be asked
simple questions about your medical condition, medication, trips to the
doctors and other related matters.
In the majority of cases, cover is provided under normal terms. If, as a consequence of your call we wish to impose special terms, these will be advised to you immediately and confirmed in writing.
Note: You do not need to telephone the Medical Screening Line if your trip is within the United Kingdom, or if you have one of the following conditions;
High blood pressure/hypertension, gall stones/ gall bladder removal, gout, cataracts, hernia, or benign lumps.
